Abstract
The research deeply explores the Islamic legal approaches in water quality control and pollution prevention. In Malaysia, environmental pollution issues such as water pollution are not enacted under the Syariah jurisdiction but Civil. This research elaborates the approaches and measures that have been applied and practiced by the Department of Environment, the State of Selangor towards controlling and preventing water pollution. All data were collected mainly through library research methodologies, institutional documentations and interviews. In order to achieve the research objectives, priority was given to comparative analysis approaches to examine similarities, differences and to determine whether the water pollution control approaches in Malaysia complied with the Islamic Law or vice versa. Based on these research findings, there are compliances between Islamic Law and the contemporary approaches. The similarities are clearly explained especially in Water Quality Standard (WQS) and taharah and najasah standard that embedded in Islamic worship jurisprudence. The unreported cases regarding inland water pollution in Selangor were analyzed from Islamic legal dimension in several aspects such as quality control, enforcement, prosecution, ratio decidendi and judgement. But, the significant laws and regulations enforced by DOE are simply controlling pollution from the point-sources and the rest pollutions from the non-point sources are continuously occurred. It happened due to unethical communities as they are not concern about ecological equilibrium, environmental sustainable and public health. Therefore, this research evaluates the Islamic Law approaches which provide more comprehensive, universal and furthermore emphasizing the legal philosophy, ethics and correlates the inter-relationship between God, human and environment as an alternative solution.
