Abstract
A document is a source of statement which in nature is dominant and authoritative in order to explain certain facts. Hence filing a Wasiyyaħ is more effective as it acts as a record where it can store and keep long term information due to the fact that a death of a person is uncertain. Therefore, this dissertation will be focusing on the prosess of drafting the document of Muslim’s bequests or known as Wasiyyaħ implemented at Amanah Raya Berhad, a Trustee Corporation in Malaysia. The primary objective of this research is to analyse the standard of drafting Muslim’s Wasiyyaħ in order to examine its consistency with the Islamic Law as exercised by the corporation. In order to achieve the objective, method of content analysis was applied. From the research, it can be concluded that the DDWA is a Wisayyaħ document which is based on the principles of Islamic Law as it follows all the arkan according to Imam Syafi’i’s view. Meanwhile, the DDWK can be considered as Wasiyyaħ document which is also based on the principles of Islamic Law. However, the researcher is of the opinion that certain clauses in both drafted documents need to be analyzed in detail so that they will be more objective, comprehensive, clear and free of doubt.
