Abstract
Public-Private Partnership (PPP) is a collaboration between the government and the private sector for the provision of public infrastructure. Numerous studies on PPP have been conducted worldwide. However, previous studies have not integrated PPP practices with Sharia compliance principles across all phases of solicited PPPs for infrastructure development. In Indonesia, solicited Sharia PPPs are promoted by ministries and local governments to support national development objectives by attracting investment, particularly from investors who prioritize Sharia compliant infrastructure development. This research aims to develop a solicited Sharia PPP framework for infrastructure development in Indonesia. The study adopts a multi method qualitative approach that includes a document review of Indonesian PPP regulations, a systematic literature review (SLR), semi-structured interviews, and validation through a Delphi study. These methods ensure a comprehensive perspective from academics, government representatives, business stakeholders, and experts from relevant organizations and associations in developing the solicited Sharia PPP framework. The findings show that the implementation of solicited PPPs in Indonesia consists of four main phases: planning, preparation, transaction, and management. Furthermore, the study identifies key Sharia compliance principles that should be incorporated into the PPP scheme and examines a preliminary solicited Sharia PPP framework, which is subsequently validated through Delphi analysis. The final framework consists of four key phases. The first phase is Sharia PPP Planning, which includes project identification, budget planning, and initial screening based on Maqasid Sharia considerations. The second phase is Sharia PPP Preparation, which covers feasibility analysis, risk sharing between parties, Sharia compliant project design, and market sounding. The third phase is Sharia PPP Transaction, which includes project location determination, procurement approval, verification of the legitimacy of project objects, identification of contracting parties, and the structuring of transactions aligned with Islamic finance instruments such as Ijarah, Musyarakah, and Sukuk. The fourth phase is Sharia PPP Management, which involves post contract supervision, the fulfillment of Sharia principles during project implementation, and end of concession procedures. This framework provides a structured approach for integrating Sharia compliance into the lifecycle of solicited PPP projects in Indonesia. Furthermore, this study offers recommendations for developing a national Sharia PPP blueprint in Indonesia and provides valuable insights for policymakers.
