Abstract

This dissertation is a study on the impact of modern technologies on hukm. It is looking particularly at the impact of telecommunications industries by using the Short Message Service (SMS). The focus of the study will try to discern whether the Islamic law can be adapted to the changing situation including the modern technologies that has been influenced the Muslim societies. Therefore, it main objectives to expose the impact of the modern technologies in the transformation of Islamic hukm. Besides, it also describes the certain fiqh’s legal theories pertaining to the contemporary Islamic law and its impact upon the use of SMS. In order to achieve such objectives, the study will utilize both the library and study case method. Some interviews were also conducted to further strengthen the information theoretical frame and provide the background of the problems. Chapter one explains the objectives of the research by explaining the definition, scope of research and the methods obtained. The study was constructed into five chapters to describe the used for this thesis as well as the literature review. The second chapter discusses the methods of hukm through the Usul al-Fiqh, the objectives of Syari’ah (Maqasid al-Syari’ah) and Syari’ah Maxim (Qawa’id al-Fiqhiyyah).The third chapter discusses the modern technologies, its history, the concept matter and its applications used by the people. The fourth chapter describes the uses of SMS in three major field of Islamic law: ibadat, munakahat and muamalat. Finally, it were followed with the final chapter, which included by some suggestions of the studies. The study finds that although the use of SMS was not become the major alteration factor in Islamic law, such SMS technologies indeed has a major impact on values and the related hukm. This can be found in the field of ibadat (donation and zakat), munakahat (marriage and divorce) and muamalat (voting for the reality TV and SMS’s banking). Therefore, a proper fiqh’s understanding is needed as a guideline for the ummah in their daily interaction when using modern technologies.
