Abstract

In term of outstanding, imam al-Izz ibn Abd al-Salam surpassed other scholars of his time. With reference to al-Shafi'i school, He was the ultimate authority to the school. This status has been testified by his student such as al-Qarafi, Ibn Daqiq al-'Id, and other scholars of his time recognised him the imam. Al-Subki also aknowledged his leadership through his writings. In term of outstanding works, Imam al-Izz bin Abd al-Salam produced books related to the rulings of evidence, namely al-Imam fi Bayan Adillah al-Ahkam, Qawa'd al-Ahkam and Majaz al-Qur'an in order to elaborate the evidence, its methodology and rulings deduction. Therefore, the aim of this study is mainly to elaborate the evidence of rulings, deductive methods of judgment and its application in the section of "Tassarufat" from perspective of fundamental study. The researcher followed the descriptive and inductive methods to achieve the objectives of this study and reach the reliable findings. The most important results is that this new division was not merely an explanation to the fundamental of evidence. However, they are rules that include linking legal judgment with tahqiq al-manat. In another word, he has developed a means that measures the impact of each stage in relation to holy texts. Among the results is his establishment of qawaid kuliyyah is quite similar to nazariyyat fiqhiyyah, however the earlier is more distinctive in term of legal proof. Based on these qawaid, al-'Izz made it his outstanding method in fatwa and legal decision.
